Columbia Missouri Police Department has been accused of misconduct. On August 1, 2009, 27-year-old Carl Giles was attending a concert at Cafe Berlin in downtown Columbia. Around 10:30 PM, Officer Jared Fielding encountered Giles in the Alley behind the venue. The officer allegedly saw Giles urinating and approached him asking him for identification. Giles denies he was urinating but rather “adjusting” himself out of view. During their initial encounter, the two engaged in a ‘verbal judo’ match in which the officer asked Giles questions seemingly unrelated to public urination including, “Do you keep that look on your face all the time?” Fielding told Giles to remain where he was standing while he walked to his patrol car to check him for warrants. Giles proceeded to instead follow the officer, insisting that because he wasn’t under arrest, he could legally stand where he wanted. A second round of ‘verbal judo’ occurred. “No, you’re not under arrest but keep standing over there,” Fielding told the man. “Well, then I can stand here,” Giles replied. “No get away from my car. I don’t want you standing close to me while I’m sitting in my car,” the officer shot back.
