Police Brutality: COEUR D’ALENE — More allegations of misconduct have surfaced against the Coeur d’Alene Police Department. An image from a video of DeLoyd Scott in an altercation with Coeur d’Alene Police officers, in which he was allegedly tasered seven times. In a federal lawsuit filed in February again the Coeur d’Alene Police Department, DeLoyd Scott claims he was tortured by being tasered seven times, as he passed by a traffic stop on his bicycle in May of 2008. However, officers say …
Police Brutality: Tasered 6X For Not Showing ID, Federal Lawsuit Filed

Even though a legislature may enact laws, such as a rule requiring you to produce I.D., all laws must strictly comply with the state and federal constitutions before it can be made a law.
Wrong boy! No one has to produce I.D.
Of course, anyone can arrest another if they want to make a citizens arrest, however, you must swear under oath that the guy/gal committed a misdemeanor or felony, or its your ass for lying.
wrong again schmitt, look at the fourth amendment and the fifth amendment, and those same state constitutions: you’re required to have a warrant if you did not observe a crime: riding a bicycle w/out a light is not a crime.
If you contacted me in a similar situation and did the same actions, i’d have you in federal court for five years on the crime of aggravated assault/battery, why aggravated?
because you displayed a weapon, did not have a stop/seizure warrant, nor a warrant for his arrest, you did not observed a misdemeanor/felony.
You would lose this one.
You better think about your actions before you think about pulling over someone that has the ability to ruin your life, just as you cause people much pain without lawful authority.
see above comments to get correct info about this type of situation.
wrong LUke! the fourth and fifth amendments are what are supposed to reign in this type of activity. Yes, if you can’t stop and have to run to daddy to get his approval, then that’s what you’ll have to do. WAKE UP DUMMY!
it’s the whites that caused the revolution, not the blacks…most blacks were slaves.
Settle the score yourself dummy!
Police are nothing more than employees of a corporation. Look at their articles of incorporation. Police have no authority outside of city hall or what property the city actually owns…no, they can not just do what this cam caught…police are just a bunch of security guards. The sheriff of the county is the only law enforcement / peace keeper, unless you have elected constables or the sheriff.
If everyone started exercising their 2nd Amendment rights, none of this would happen. Burglars, rapists, robbers, assaulters would simply be disposed of rapidly…hence, no need to spend money on keepin them alive. Ropes are still good too.
Wrong! The police can’t detain to get evidence. They can request a name and where such person is domiciled, then run home to daddy and get a warrant to receive a copy of the tape. They aren’t allowed to seize the original.
If asked, you can assert the fifth and not give anything up, especially since their is no 4th amendment warrant. They are without observing a misdemeanor / felony without cause to stop/seize or detain.
IQS generally below 50.
being properly identified only is justifiable when someone has been observed committingt a crime. Identity in itself is “who you say you are.” how is this, failure or refusal to identify you can still go to jail and serve time as john doe…only thing is they can’t really get a rap sheet built up on you.
Menace, i see why you call yourself that word. You are a self confessed moron! First, it is not illegal to film, photograph public servants performing their duties out in public. It may be unreasonable in an office, but who owns the public buildings anyway? It is the people, which means me and anyone else out here that can prove he is one of the people. sorry don’t need to have a government approved document saying so, just good documentary evidence of such.
You are a whiney cry-baby who was asking for trouble and got what you deserved. I hope your case gets tossed out of court if it already hasn’t!
Ok, so next time your riding your bike down the street and a cop tazes you mutiple times then arrests you for not showing your ID, which you are not legally required to carry unless your driving a car which does not = bike, you tell me you would agree with it.
looks like the cops were up to no good ……..thats messed up man
I went to the US Supreme Court on this same manner. 4-total courts and our country’s highest court said I was right. You must provide ID (driving or otherwise) when encountered under suspicious circumstances. All a cop needs. These cops will win. The people filming this???? You should have been arrested for Obstructing and Delaying an Offficer at a minimum. No wonder Northern Idaho is full of constitutionalists. And I grew up there. Look up Hiibel V. Nevada. Congrats to my brothers on case!
“KevinMichaels”,…..You are completely and totaly wrong. Your Law and legal statements are inaccurate. RS (reasonable suspicion) is all that is needed to ID someone. And, if encountered under those circumstances you can be arrested…..period. Again, I lived it! Research Hiibel V. Nevada and educate yourself.
“Kevinmichals” is definately not an attorney and if he is,…..he must chase alot of Ambulances. What a freaking malcontented Democrate!
i hope you and me meet somday and have a nice talk about correct law and incorrect law. i have a bs in criminal justice and i have graduated post. so i dont understand why you can even argue with this people. kevin you just cant stand control thats what i think it it is just like every one els that cant stand the cops. just you took it to the next level and iam pretty sure your going to end up in jail or worse.
and pls dont respond to this comment i feel that talking to you brings my level of inttligents down to your level and we cant have that thank you and get a life.
