Janice Wells, 57, called the Richland Police Department when she feared a burglar was outside her clapboard house in a rural west Georgia town. Minutes later when an officer came to her backdoor, she was screaming in pain and begging another officer not to be shocked again with a taser. The second officer joined the first one to complete the old woman’s trauma. With each scream and cry, the officers threatened her with more shocks. Much of what happened in front of Wells’ house was recorded by the camera on the dash of one of the officer’s patrol car. The minute-long dashboard video shows the officer pulling up to assist another officer. The third-grade teacher can be heard on tape screaming ‘don’t do that’ as a stun gun is heard repeatedly zapping. Wells told the Atlanta Journal-Constitution in an interview, “All of it is just unreal to me. I was scared to death. He kept tasing me. My fingernails are still burned.” Ryan Smith of the Lumpkin Police Department has resigned and Tim Murphy of Richland Police Department was fired for using pepper spray and a stun gun on the woman.

Beyond civil suits, I still cannot find where the federal government is given sole authority to prosecute state or local police officers. I cannot even find it in the U.S constitution OR US Code. By that logic alone (not to mention the 10th Amendment), if the power is not allotted to the Federal government, it is an implied power, and therefore subject to state jurisdiction.

which, yes, I did find thanks to your link. In that link however, I also found that the JOD works closely with state and local law enforcement to curtail ecxessive use of force. Basically, states and towns acting on their own against the problem is still well within set and legal bounds.

Now the fact that the Department of Justice and hence the federal government has the power to put a stop to the abuses of power we see above, yet seem complacent to do anything about it would conclude me back to my original statement based on who is currently running the federal government.

Possibly. But look at the latest versions of those laws. 1968 and 1994 is when they were enacted. To say that the current admin is to blame is kind of pushing the bounds of a reasonable argument. No. I would much more say it’s the DOJ as a whole that has been slacking over the years. Given the prevalence of issues the White House deals with on a daily basis (and I’m not just saying that for Obama, but from Reagan on up) is there any wonder why this issue is left to the states?
