@MiClLC I didn’t clarify, not just being on the ground but mainly if you are unconscious or unable to defend yourself. The fans had the intent to cause harm if not death and knew death was a possible outcome. I am not sure what the state statute reads however it is a fact that a police officer or anyone with a concealed weapons permit would be justified to shoot another if they witnessed this happening.
