and ziva has said and proven that she has had to get into relationships that she didn’t want to get into to get info/intel about something she is trying to figure out. I think that may be what is going on here.
She is probably kissing him to get something from him. So it isn’t a real kiss.
Like someone else has pointed out, Ziva is wearing the same clothes as in the end of Aliyah when she’s puting the picture on her ship bunk wall. Also when she’s kissing Not Tony she has a necklace on, the necklace Salim broke from her neck….

Why don’t you all let us believe what we want to believe (tony or not) – Because this Tiva thing (and I’m a huge fan) has been dragged on so long that first thing you see tend to get the jump on you and you dont really care for the facts on it.

What im guessing about the kissing picture is maybe it was from when she was deployed on that ship before she came back to Ncis
It is NOT Tony whom Ziva is making out with on the tanker Damocles; that happened hours AFTER Tony, Vance, and Gibbs left Tel Aviv in Season 6’s “Aliyah.” Ziva’s father immediately dispatched her on a mission on the Damocles to Somalia while Tony was in Washington DC interviewing replacements for Ziva; trying to convince Vance to capture/kill Saleem; and all the while trying to solve the homicides of three Navy sailors.
Damn…get with the story arcs, dammit.
