Texas Gun Shows Organizer Targeted by the ATF Makes His Case on the Alex Jones Show Kurt Nimmo www.infowars.com January 18, 2010 Darwin Boedeker of Texas Gun Shows appeared on the Alex Jones Show today and provided details of the criminal conspiracy by the Bureau of Alcohol, Tobacco, Firearms and Explosives (abbreviated ATF) and the Austin police to shut down the show last week. Under the Commerce Clause of the US Constitution, the ATF has absolutely no authority to regulate gun sales between private individuals on the state of Texas. In a classic case of Mafia intimidation, the ATF in league with the Austin Police Department leaned on Boedeker in a brazen and illegal attempt to scare away participants and ultimately close down his business. On Thursday, January 14, Mr. Boedeker was asked to meet with representatives of the ATF and Austin police at a building in Austin used for police interviews and interrogations. In addition to Boedeker, the two hour meeting included the participation of HEB, an Austin grocery retailer. HEB holds the lease on the building where the Texas Gun Shows events are held on the third week of every month. Police, under the direction of ATF, told Boedeker he would be required to follow their recommendations or they would close down his event. Boedeker said he was told you do what we say or we shut you down. He said the ultimatum was recorded by the police and ATF. Mr. Boedeker indicated enforcing the ATF recommendations would destroy his business …

So are you saying that there shouldn’t be any limits on anything? Make libel and slander legal? Let anyone take any weapon they want into any building? Believe me, I am all for civil liberties, but I realize that you have to put rational restrictions on somethings. If there is a law abiding citizen who wants to own a gun either for protection or sport then they have every right to, but wouldn’t it make sense to run background checks to make sure we arent giving weapons to criminals?
Because if you go through a FFL, they charge a transfer fee of usually $30-45, which raises the gun’s price, and because THIS WILL RUIN OUR CIVIL RIGHTS!
All of the laws regarding “background checks” use wording similar to “causing to be possessed”. So I can’t cause someone to possess my weapon unless they go through a background check. Want to go shooting with friends? You’re now a felon. Want to show a new collectors item to a friend? You are a felon.
Further, there is no “reasonable restriction” on requiring background checks. My parents have both given me guns, I’ve bought guns from my family members and sold to friends I’ve known well. ALL of that would go away with this bullshit background-check regulations.
Also, federal law SPECIFICALLY states (IRS code of 1986) that an individual selling parts of their collection is NOT an FFL, and therefore does not fall under FFL regulations… including the required background check.
Last year Jones had the Austin Chief of Police on his show. He asked Jones to call him if he had any further questions. It’s time to bring him back on the show!

I don’t know about that. I do know that if the government does take away our rights, I’m going to give them hell. Hopefully, I’ll be able to stock pile a few firearms before my rights are taken away from me. The American colonist for for their freedoms and rights. American citizens should do the same should a corrupt government take them away.

Cripes, I really want to hear this Boedeker guy explain what happened, and I am glad that Alex Jones has him on to speak, but he won’t shut up and let the guest speak.
Gun show operators are required to get municipal license &/or permit before business is conducted. There are alot of requirements that must be met, building must meet fire & safety codes, traffic & parking issues must be resolved, & there are insurance & fees to be paid.
No one claims that these requirements are obstructing commerce.
If Boedeker wants to sell guns w/o complying with the requirements & requests of the local authorities then I suggest he sell them from his private residence.
@rllang01, but as he said in anothe video I see, the ATF was making a big deal about private sellers selling to private buyers saying it wasnt legal and they had to shut down. This happened in Texas and the thing is though in Texas the law clearly states a person can sell a fire arm privately to another citizen without a background check required. But the ATF basically is ignoring that fact and saying how its illegal to do that.

@rllang01, yep thats why I am like amazed wondering how we got where we are. What ever happened to just owning a fire arm you want without being taxed. Sure we dont have to have a full auto machine gun but what about those of us that are gun collectors, what about those of us that enjoy going to full auto machine gun shoots. Its like their using their weight to make money by taxing people which I am just wondering if its legal to tax people monthly to own a class III weapon.
@Milner62 This is an issue of commerce, not the ownership of firearms, this is about “for profit” vendors selling their merchandise. We have the freedom of the press but taxes are applied when buying a news paper and the news paper vendor must first obtain a business permit.
Example, A Wal-Mart store may be restricted by local ordinance of allowing private persons to sell used cars in their parking lot, even if the Wal-Mart manager agreed. Is your right to “Freedom of Movement” infringed ?
