According to Chris, (via email): Me and my brother were walking on the boulevard right off the boardwalk. A police car pulled up by us about 20 yards away so I pulled out my phone ready to film. Nothing happened after standing there for a minute so we started walking away. We were about 35 yards away when the cop got out of his car and told us to stop. This is when I pulled my phone back out and started recording the officer walking up to me. He quickly took my phone and violated my rights. Me and my brother were separated. He was handcuffed peacefully a short while later. Eventually he was thrown to the ground and beat. I continued to be harrassed for not giving my ID and was told I would be arrested if I didnt hand it over. I handed it over without consent after a very long time asking what crime I commited. I continued to be harrassed and after a while they gave me a ticket for public nuisance and my brother was arrested for aggravated assault. He was taken away and subsequently beat in jail. We got him out on 25000 bond the next day at the county jail. He has marks and scratches all over his body. He also broke his nose. After all was said and done I asked Officer Anderson for his badge number but he told me I better leave and refused. More at: copblock.org
When asked for ID just say your name. They will then want verification. If you are with other people you know – just ask them to vouch for you that it is your name. That’s it. You have not done anything wrong and can go on taking the video – you may just want to back up away from the cop if possible.
Seaside cops are always on the edge idk why but a couples years back i went to seaside after my prom…and a teenager was on his phone and a cop pull his gun out and told him to get on the ground….turns out that he was look for a kid that did a hit and run and he had the same colored shirt on but there cops they can do what they want……
there is no such thing as being detained,you’re either free to go or arrested so sayeth the supreme court.

I want all cops to know that I do not hate an officer but real officers are few and far between. bad cops are the majority and that is a sad fate.
@Snowblindinfinity there are 11 states that have the 2 party consent law and I am alomost positive that 3 counties have used that law to rule you can not record police while they are on duty. so there are places where people have made the expectation of privacy arguement, the public job public place arguement and a court has ruled against it in the name of protecting police
Its very odd that people continue to get arrest for filming rather then contacting a legislator and having the law stricken from the books?……but whatever, its a great away for me to pass the time at work so keep filming retards..

@MsSarahJ56 Statutes are applicable only to corporate entities under the jurisdiction of the Corporate De Facto Government. People should study the statutes, all of them are commercial in nature and most only limit the actions of commercial and pseudo-government entities. They are not constitutionally compliant “law of the land”. In fact de facto corporations cannot make laws, nor can they lawfully rule except by contractual consent. They offer “Services” at the point of a gun, comply or suffer.

@MidnightWins2 Who’s to say it’s Bullshit? After the Civil War the republic was dead. Lincoln replaced all the representatives of the southern states with his own people and since that time the corporate government which is owned by the banks has been in control of this country. History proves this point. Of course then again, who is to say the real history? I study the statutes, the Presidential Orders, Congressional Acts and other government sources to determine my view on it. No easy task.

@DavidLister6000 The statutes allow recording of public officers in almost all cases. What you don’t understand (and I do because I’ve had case involvement and court experience) is that the cops NEVER FOLLOW THE LAW. Not in a single case do they obey their own rules. Not ONE. If you learn the law (my channel is a good place to do that) you’ll see that. So it’s not the laws, it’s the COPS and COURTS that don’t OBEY THEM that is the problem. But it stands if NOT REBUTTED. That puts it back on us

@DavidLister6000 Let me jump in here- Glik v Cunniffe, US 1st Circuit Crt of appeals handed down last week. Glik was arrested in Mass. for videotaping an arrest, under Mass. ‘wiretap’ statute. Court held that a) videotaping cops openly is a clearly established, fundamental right (1st amd-decision is online and cites previous cases) , b) officers violated 1st AND 4th amd. rights of Glik when they arrested him, and c) NO CIVIL IMMUNITY FOR COPS WHO ARREST FOR FILMING (cops not taxpayers pay).
@brian241 if on reads MGL 272/99 “secret” does not appear in the statute but does in the definitions, so on the face, those arrests are( were) lawful. Now, after the courts clarification, its unlikely that arrests will occur as the court has handed down a decision, unless the state appeals. The claim that said recording were done in “secret” will be issue as well as two party consent and also reading the decision, there are limits on filming. Better to repeal the law I would think…
@DavidLister6000 Further, this was from 2007 and was the state’s appeal of a lower courts decision. Of course this decision only pertains to the affected district. There are still states that have two-party consent laws. I would dare say its better to petition those state legislators and have the law removed rather then waiting 4 years for a case to be resolved. But I do like watching the videos – silly hippies.
